These Terms of Service ("Terms") form a legal agreement between you and Miranda Huang (NiHao 开发者) regarding your use of the NiHao Chinese learning app ("the Service").
Last updated: 2026-05-31. By registering an account or continuing to use the app, you accept these Terms.
By registering, logging in, or using any part of the Service, you confirm:
• You are 16 years or older (do not use NiHao if under 16)
• You have legal capacity to enter this agreement
• You agree to comply with these Terms and the Privacy Policy
If you disagree, please do not use the Service and uninstall the app.
Registration: sign up with email/password or Google / Apple account. Each user is limited to one account.
Security: keep your password safe · do not share with others. Contact us immediately if you suspect unauthorized access.
Accuracy: provide truthful information · update when it changes.
Termination: you may delete your account anytime via "Delete account" in the app. We also reserve the right to suspend or terminate accounts that violate these Terms.
NiHao offers a free tier and Premium subscription.
Premium pricing (Vietnam market · tax included):
• Monthly: 79,000 VND/month
• Quarterly: 149,000 VND/3 months (≈ 49,667 VND/month · 37% off vs monthly)
• Yearly: 399,000 VND/year (≈ 33,250 VND/month · 58% off vs monthly)
Prices in other regions are converted by Apple / Google to local currency · the in-app purchase page is authoritative. Subscriptions auto-renew until you cancel.
Billing: via Apple App Store (iOS) or Google Play (Android). We do not directly handle your payment information.
Free trial: first-time subscribers may receive a 7-day free trial · you can cancel anytime during the trial (no charge).
Cancellation: manage subscriptions in Apple ID / Google Play settings. Cancel at least 24 hours before the next billing cycle.
Refunds: handled per Apple / Google refund policies. We do not process refunds directly · please apply via the relevant platform.
When using the Service, you agree NOT to:
• Engage in illegal, fraudulent, harassing, hateful, or obscene behavior
• Crack, reverse-engineer, or gain unauthorized access to the Service
• Post content that infringes others' intellectual property
• Abuse AI chat (including: bulk requests, attempting to bypass limits, generating harmful content)
• Use bots / scripts to automate operations
• Impersonate others
Violations may result in account suspension · serious violations may result in permanent ban.
NiHao content: HSK lessons, vocab cards, example sentences, the Capy character, and UI design are created, curated, or licensed by NiHao. Some visual assets (e.g. the Capy character, illustrations) may be produced with the aid of AI tools.
Regardless of how copyright vests, you are granted only a **personal, non-commercial use license** — you may not copy, distribute, create derivative works, use for commercial purposes, or use the content to train your own AI models. Violations will result in account termination and may be pursued legally.
User content: content you submit in feedback or notes remains yours. You grant us a worldwide, royalty-free, non-exclusive license to use it to provide and improve the Service.
Capy AI provides AI-based language learning assistance · it may contain inaccurate or incomplete content.
AI output is for learning reference only · it does not constitute professional language teaching, translation certification, legal / medical / business advice. Consult human experts for important matters.
We continuously improve AI quality but do not guarantee zero errors.
The Service is provided "AS IS" without any express or implied warranties, including but not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted / error-free operation
You use the Service at your own risk. We do not guarantee the Service is available on all devices at all times.
To the maximum extent permitted by applicable law, our liability is limited to:
• Total amount not exceeding what you paid us in the past 12 months
• No liability for any indirect, incidental, special, or punitive damages
• Not responsible for failures of third-party services (Apple / Google / Firebase, etc.)
Some jurisdictions may not allow these limits; in such cases, liability is limited to the maximum extent allowed by law.
We reserve the right to:
• Modify, suspend, or discontinue the Service at any time (including free or Premium features)
• Terminate your account immediately upon Terms violation
• Adjust the Service due to business decisions, legal requirements, or force majeure
Material changes will be announced in advance via in-app notification.
These Terms are governed by the laws of the People's Republic of China, where Miranda Huang (NiHao 开发者) (individual developer) is based, unless mandatory laws of your jurisdiction provide otherwise.
Disputes are first resolved through good-faith negotiation. If unresolved, they are submitted to the competent People's Court at the developer's place of residence (China).
EU / UK / California users: these Terms do not affect non-waivable rights you have under mandatory local laws (GDPR / UK-DPA / CCPA, etc.).
We may update these Terms. Material changes will be announced in-app, and the "Last updated" date at the top will be refreshed.
Continued use after changes take effect means you accept them. If you disagree, please stop using and delete your account.
